Report on the extraordinary meeting of the GudV (Assembly of Shareholders and Delegates)

In an extraordinary meeting on 19 August, the Assembly of Shareholders and Delegates (GudV) adopted new regulations on the remaining open budgets.

The agreed adjustments in the distribution regulations for performers provide the basis for the distribution of remuneration for the years 2010 to 2016 in 2021. Open budgets include docusoaps and other documentary productions, individual contributions in audiovisual productions, jingles, commercials on television and radio, and title and background music in audiovisual productions and radio plays.

In recent years, GVL has fundamentally changed its distribution systems and adapted the necessary technical infrastructure to the requirements of the German Collecting Societies’ Act (VGG).

Now that the remuneration for the economically largest revenue categories has been distributed on this basis, the distribution of the remaining open budgets, which had to be put on hold so far due to the inconsistent data situation, is now due. Since the data can only be prepared with a disproportionate amount of manual effort, the Assembly of Shareholders and Delegates has opted for a so-called form-based solution in order to capture the remuneration entitlements.

In this process, rights holders register their contribution throughout in the form of a self-declaration. We will inform performers entitled to participate in this process about the registration modalities by e-mail. The distribution of remuneration for the years 2010 to 2014 is planned for the first half of 2021, and for the years 2015 and 2016 for the second half of 2021.

In addition to the resolution on open budgets, the ordinary Assembly of Shareholders and Delegates, which took place as early as last May, approved a number of minor adjustments to the distribution regulations, which will enable more efficient operational distribution processes. These include, among other things, the possibility of paying out remuneration to rights holders, even if it is less than EUR 5. The list of channels to be analysed for all media types was also updated as scheduled, based on the general criteria of the distribution regulations.
